Pelli's Terms and Conditions

1. Purpose and scope

These Terms and Conditions (hereinafter "T&Cs") govern the contractual relationships between Lumy.Media, SAS with a capital of 2000 euros, registered with the RCS of Brest under number B 889 608 790, with its registered office in Brest (hereinafter "Pelli" or "we"), and any natural or legal person, individual or professional, subscribing to our photo gallery management services for photographers (hereinafter the "Client" or "you").

These T&Cs apply to the exclusion of all other conditions and are accessible at any time on our website. Any subscription to our services implies unconditional acceptance of these T&Cs.

2. Description of services

Pelli provides an online platform allowing photographers to manage, share, and deliver photo galleries to their clients. Our services include storage, gallery customization, and various features detailed on our website.

3. Subscription plans and pricing

Pelli offers three subscription plans, available in monthly or annual payment:

3.2 Monthly rates

• PRO: €15/month
• ULTRA: €35/month

Prices are in euros and excluding taxes. Pelli reserves the right to modify its rates at any time. Any price modification will be notified to the Client by email at least 30 days before it takes effect.

Annual subscription offers a significant discount compared to monthly subscription. No hidden fees are applied, regardless of the chosen plan.

4. Subscription and duration

Subscription to our services is done online on our website. The subscription takes effect on the subscription date and is concluded for an indefinite period, with monthly billing.

5. Payment

Subscription payments are made monthly by automatic debit from the Client's credit card. Payments are secure and processed by our payment provider Stripe. The Client guarantees that they have the necessary authorizations to use this payment method.

In case of late or default payment, Pelli reserves the right to suspend access to services until payment is regularized.

6. Right of withdrawal and refund policy

In accordance with Article L221-18 of the French Consumer Code, the Client has a period of 14 days from subscription to exercise their right of withdrawal, without having to justify reasons or pay penalties.

Beyond this period, any refund request will be studied on a case-by-case basis, without guarantee of acceptance. No refund will be made for started subscription periods.

7. Termination

The Client can terminate their subscription at any time via their personal space on the Pelli platform or by contacting customer support at [email protected]. Termination takes effect at the end of the current monthly period.

In case of serious breach by the Client of their obligations, Pelli reserves the right to terminate the subscription without notice or compensation.

8. Modifications to services and T&Cs

Pelli reserves the right to modify its services, add or remove features. Clients will be informed of substantial modifications by email and via a monthly changelog.

Pelli may also modify these T&Cs at any time. The new T&Cs will be notified to the Client by email and will require new acceptance to continue using the services.

9. Intellectual property and usage rights

The Client retains all intellectual property rights to the content (photos, videos, etc.) they upload to the Pelli platform. By using our services, the Client grants us a non-exclusive, worldwide, free license to host, store, transfer, and display this content, solely for the purpose of providing Pelli services.

Pelli remains the owner of all intellectual property rights relating to the platform, website, trademarks, logos, and any other distinctive element.

10. Personal data protection

The processing of Clients' personal data is governed by our Privacy Policy, accessible on our website and forming an integral part of these T&Cs.

11. Availability and maintenance

Pelli commits to ensuring 99% service availability on an annual basis. Planned maintenance operations will, whenever possible, be carried out outside peak hours and notified to Clients in advance.

12. Limitation of liability

Pelli cannot be held responsible for content uploaded, shared, or distributed by Clients via our platform. The Client is solely responsible for the content they upload and commits to respecting third-party rights and applicable legislation.

Pelli's liability can only be engaged in case of proven fault and is limited to direct damages, excluding any indirect damage, within the limit of the amount paid by the Client for services during the 12 months preceding the event giving rise to the claim.

13. Customer service and support

Pelli provides customer service accessible by email at [email protected]. We commit to providing a first response within a maximum of 48 business hours, with an observed average response time of 2 hours.

14. Applicable law and jurisdiction

These T&Cs are governed by French law. In case of dispute, the parties will endeavor to resolve it amicably. Failing amicable agreement, any dispute relating to the validity, interpretation, or execution of these T&Cs will be submitted to the competent courts of Brest, subject to contrary mandatory legal provisions.

15. Miscellaneous provisions

If one or more provisions of these T&Cs are held invalid or declared as such under a law, regulation, or final decision of a competent court, the other provisions will retain their full force and scope.

The fact that Pelli does not invoke at any given time one of the clauses of these T&Cs cannot be considered as a waiver to invoke it later.
